Kirby's video has bits of truth laced with misinformation. No patent covers just a "material object" alone. Most people don't even know about patent claims. Copyrights and patents are very different - patent is not about copying at all (it is about exclusion of use).

This is the problem with intellectual property in society - most people don't understand it, and videos like this just propagate misinformation.
