Current federal minimum wage is $7.25 the only state with $7.79/hr is Florida so I'll assume you're from there. I don't know what the laws were 11 years ago, they probably weren't required to pay minimum wage, but the current wage laws require employers to pay the difference if your tips don't meet minimum wage.
According to that table the minimum wage your employer can pay you(in Florida) is $4.77/hr and if your wage plus tips is less than $7.79/hr your employer is required to make up the difference. If you or anyone you know is paid less than minimum wage because they are tipped workers you/they should contact the Department of Labor's Wage and Hour Division to file a complaint. This should help.

I'm not saying you shouldn't tip, just that they are guaranteed wages even if you don't.
Emergency rooms are required to treat patients with emergency medical conditions regardless of inability to pay, so it would be extremely unlikely for this to happen in the U.S.
