Burglar Unwisely Shoots 90-Year Old Man in the Head

All this accomplished was to enrage the homeowner, 90-year old Jay Leone of Greenbrae, California. Leone then returned fire:

"To tell you the truth, I never felt a thing," said Leone, 90, of Greenbrae. "I said, 'F—- you, you son of a bitch, now it's my turn.'"

Whereupon he shot five bullets at the suspect from his .38-caliber Smith & Wesson snubnose revolver, hitting the burglar three times in the abdomen. A scuffle ensued between the wounded men.


The suspect then fled the scene. He eventually sought medical treatment for his wounds, leading to his arrest. Leone summoned the police and told them how he was able to get to one of his guns while the burglar ransacked his house:

Leone said he concocted a plan: He said he needed to use the bathroom, which is where his five guns were hidden. When the burglar refused, Leone pulled his pants down and said he would defecate on the spot.

The burglar let him leave for the bathroom but would not let him close the door, Leone said.

"I said, 'Do you like to watch people take a s—-?'" Leone testified. The burglar let him close the door, and Leone went for his Smith & Wesson snubnose.

Must have been using the wrong load for the guy to survive three to the abdomen. Those old round-nose, 158-grain lead or FMJ just don't work like a 130-grain Gold Dot Hollow Point

People like you seem so determined to dig their heels in, I'm sure you'd refuse to take even the advice of guys like Gavin DeBecker, Massad Ayoob, Marc MacYoung, Rex Applegate, Tom Brown Jr., etc., if they had been linked through Neatorama.

There's no evidence that Rumson's comment is any more correct than my comment, not even a link to another Neatorama post. I accept Neatorama as the ultimate authority in many of the important facets of my life, but not in this case.

The fact of the matter is that, as a result of his own actions, the old man was shot. He deliberately provoked the confrontation, and escalated a potentially violent situation into actual violence.

And he's proud of the fact. Would I have done the same thing? Maybe. But I've done some pretty stupid things, too.

ACtually, no, Rumson, the chances of getting shot by a robber are fairly low. In fact, the chances decrease the longer the robber delays. If he's not going to shoot you within the first 30 seconds, your chances of survival actually improve, if you remain cooperative and reasonable.

You're more likely to be shot by a family member than in a home invasion.

The chances of getting shot by a robber are pretty high, even if you cooperate. They tend to decide it would be best to eliminate any witness to their crime. May as well shoot the bastard first.

How did he get to be so old, behaving so recklessly?

Not that I blame him, but if he hadn't gone for his own gun, would he have been shot in the first place? Sounds like he forced the burglar's hand.
