Hilarious Response to Cease and Desist Letter



The Freetail Brewing Co. of San Antonio, Texas discovered that the name of one of its beers was claimed by another company. It learned this fact when it received a threatening letter from the attorney of that company. The brewers decided that fighting the issue wasn't worth the trouble, but wanted to have a bit of fun with their response. Pictured above is a screenshot of part of the letter, which can be found at the link. Much to Metzger's credit, even though he didn't go to law school, he knew about the advantage of sending a copy to the Flying Spaghetti Monster.

It was funny except for the FSM bit. I don't know how religion (or the making fun of) fits into any of this and the whole flying spaghetti monster is really played out anyway.

Lawyers *always* tell clients that they should never contact the opposition directly as it may compromise the case. Actually a polite letter along the lines of "Were you aware that we already sell a beer by that name? Would you be kind enough to change the name of your product." could do nothing to to prejudice a case against the originator of the letter. Lawyers however will always advise against taking such action since a lawyer's letter will make them four figures for ten minutes work.

Google tells me there are at least three breweries making a beer with this name... I wonder what how the other company that I'm sure got a C&D responded. Maybe they will see this and get inspired. But they did get one thing right in the letter -- big waste of the thousand dollars they probably paid their lawyer to do this. In the end all it did was get their competitor a bunch of free press for having a sense of humor.
